1. Introduction

Welcome to DreamPop Tales ("DreamPop Tales", "we", "us" or "our").

These Terms & Conditions govern your use of our website, the purchase of our products and your relationship with DreamPop Tales.

By accessing our website or placing an order, you confirm that you have read, understood and agree to be bound by these Terms & Conditions, together with our Privacy Policy and any other policies referenced on our website.

DreamPop Tales creates personalised children's books made especially for each customer. Because every book is produced to your individual specifications, some rights and obligations differ from those that apply to standard retail products. Please read these Terms carefully before placing your order.

We may update these Terms & Conditions from time to time to reflect changes to our business, products or legal obligations. The latest version will always be available on our website and will apply from the date it is published.

2. Eligibility

You must be at least 18 years old to place an order with DreamPop Tales. By placing an order, you confirm that you are 18 or over and have the legal capacity to enter into a binding contract.

Our products are intended to be purchased by adults, such as parents, legal guardians or other authorised individuals, as gifts or for personal use. We do not knowingly accept orders directly from children.

3. Definitions

For the purposes of these Terms & Conditions, the following definitions apply:

"Buyer", "Customer", "You" or "Your" means the individual or organisation purchasing products from DreamPop Tales.

"Website" means www.dreampoptales.com and any associated webpages operated by DreamPop Tales.

"Product" means any personalised or non-personalised book, gift or other item offered for sale through our Website.

"Personalisation Information" means any information you provide to customise your Product, including but not limited to:

  • Child's name
  • Additional child names (where applicable)
  • Character selections
  • Uploaded photographs
  • Personal dedication messages
  • Book language
  • Any other personalised content submitted during the ordering process

"Order" means your request to purchase one or more Products through our Website.

"Order Confirmation" means the email confirming that we have accepted your Order.

"Contract" means the legally binding agreement formed between you and DreamPop Tales once your Order has been accepted and confirmed.

"Working Day" means Monday to Friday, excluding public holidays in Romania.

"Personalised Product" means any Product manufactured specifically according to the Personalisation Information you provide.

4. Using Our Website

You may use our Website only for lawful purposes and in accordance with these Terms & Conditions.

By using our Website, you agree that you will not:

  • Use the Website in any way that breaches any applicable laws or regulations.
  • Attempt to interfere with the security, operation or functionality of the Website.
  • Upload or transmit any viruses, malicious code or harmful software.
  • Attempt to gain unauthorised access to our systems or customer information.
  • Use automated tools, bots or scraping software to collect information from our Website without our prior written permission.
  • Use our Website in any way that could damage, disable or impair its performance or interfere with another customer's use of the Website.

You are responsible for ensuring that any information you provide is accurate, complete and up to date. We reserve the right to suspend or restrict access to our Website where we reasonably believe these Terms & Conditions have been breached or where necessary to protect our business, customers or systems.

5. Intellectual Property

All content available on the DreamPop Tales Website is owned by or licensed to DreamPop Tales and is protected by applicable intellectual property laws.

This includes, but is not limited to:

  • Book stories and written content
  • Illustrations and artwork
  • Character designs
  • Product photography
  • Logos and branding
  • Website design
  • Graphics and icons
  • Videos and animations
  • Digital downloads
  • Software and website content

You may access and use our Website solely for your personal, non-commercial use.

You may not, without our prior written permission:

  • Copy, reproduce or distribute any content from our Website.
  • Modify, adapt or create derivative works from our content.
  • Use our illustrations, stories or designs for commercial purposes.
  • Remove or alter any copyright, trademark or proprietary notices.
  • Use our trademarks, logos or branding in a way that suggests an affiliation with DreamPop Tales.

Customer Content

By uploading photographs, names, dedication messages or other personalised content to create your book, you confirm that:

  • You own the content or have permission from the copyright owner or legal guardian to use it.
  • The content does not infringe the intellectual property or privacy rights of any third party.
  • The content does not contain anything unlawful, defamatory, abusive, hateful, discriminatory, obscene or otherwise inappropriate.

Uploading content to personalise your book does not transfer ownership of that content to DreamPop Tales. You retain ownership of your photographs and personalised content. You grant us a limited licence to use that content solely to create, produce and deliver your personalised order and to provide related customer support.

We reserve the right to refuse, cancel or suspend any order containing content we reasonably believe breaches these Terms or applicable law.

6. Orders & Personalisation

A. Placing an Order

To place an order, follow the ordering process on our Website and provide the requested information. Once payment has been successfully processed, you will receive an Order Confirmation by email, at which point a Contract is formed.

We reserve the right to refuse or cancel any Order at our discretion, including where:

  • the requested Product is unavailable;
  • payment cannot be authorised;
  • incorrect pricing or technical errors have occurred;
  • the personalised content breaches these Terms & Conditions;
  • we reasonably suspect fraudulent or unlawful activity.

If we cancel your Order after payment has been taken, you will receive a full refund.

B. Your Responsibility

Because every DreamPop Tales book is individually created, you are responsible for carefully reviewing all personalisation details before completing your purchase, including:

  • spelling of names and dedication messages;
  • uploaded photographs;
  • character selections and book language;
  • shipping address; and
  • any other personalised information submitted during the ordering process.

DreamPop Tales is not responsible for errors resulting from incorrect information you supply. If you notice an error after placing your Order, please contact us immediately. Once production has begun, changes may no longer be possible.

C. Personalised Content

You agree that your personalised content:

  • is accurate;
  • does not infringe the rights of any third party;
  • is not unlawful, offensive, defamatory, abusive or discriminatory;
  • does not contain material that could reasonably be considered inappropriate for children.

We reserve the right to refuse or cancel any Order containing content that we reasonably believe breaches these Terms & Conditions or applicable law.

D. Product Availability

All Products are subject to availability. We may update, discontinue or replace Products without prior notice and reserve the right to modify our product range, pricing or specifications at any time before an Order is accepted.

7. Right of Withdrawal, Returns & Cancellations

Important notice regarding your right of withdrawal: DreamPop Tales books are made specifically to your individual specifications and therefore constitute personalised goods. Under Article 16(c) of the EU Consumer Rights Directive and the equivalent UK Consumer Contracts Regulations 2013, personalised goods are exempt from the standard 14-day right of withdrawal. By ticking the acknowledgement box at checkout and completing your purchase, you confirm that you understand and accept that your right of withdrawal does not apply once production of your personalised book has begun.

A. Before production begins

If you wish to cancel your Order, please contact us immediately at hello@dreampoptales.com. Where production has not yet started, we will do our best to accommodate your request and issue a full refund. Once production has commenced, cancellations are not possible.

B. Non-personalised products

If you purchase any non-personalised Product, you have the right to cancel your Order within 14 days of receiving it without giving any reason. To exercise this right, please contact us at hello@dreampoptales.com within 14 days of delivery. The Product must be returned in its original condition at your cost. We will issue a full refund within 14 days of receiving the returned Product.

C. Faulty, damaged or incorrect products

If your Product arrives damaged, contains a manufacturing defect, differs materially from your Order, or contains an error caused by DreamPop Tales, please contact us within 14 days of delivery with photographs showing the issue. Where appropriate, we will offer:

  • a replacement Product;
  • a full refund; or
  • another appropriate remedy depending on the circumstances.

D. Customer errors

We cannot offer refunds or free replacements where the issue results from information you provided, including spelling mistakes, incorrect names, dedication messages, character selections, photographs, language selections or delivery addresses. Please review all personalisation details carefully before completing your purchase.

E. Your statutory rights

Nothing in these Terms limits any mandatory rights you have under applicable consumer protection legislation, including rights in relation to faulty or misdescribed goods.

8. Pricing & Payment

All prices displayed on our Website are shown in the applicable currency and include taxes where required by law, unless otherwise stated. Delivery charges, where applicable, are shown during checkout before you complete your purchase.

We reserve the right to change prices at any time. Changes will not affect Orders already confirmed. If a pricing error occurs, we reserve the right to cancel the affected Order and issue a full refund before production begins.

Payment must be made in full at the time of ordering. DreamPop Tales does not collect or store your full payment card details. Payments are processed securely by trusted third-party providers.

By placing an Order you confirm that:

  • the payment method used belongs to you, or that you have the necessary authorisation to use it;
  • all billing information provided is accurate and complete; and
  • sufficient funds are available to complete the transaction.

If your payment cannot be authorised or completed, we reserve the right to refuse or cancel your Order until payment has been successfully received.

9. Promotions & Discount Codes

From time to time, we may offer promotional codes or discounts. The following conditions apply:

  • Promotional codes must be entered at checkout and cannot be applied retrospectively to completed Orders.
  • Only one promotional code may be used per Order unless otherwise stated.
  • Codes cannot be combined with other offers unless explicitly permitted.
  • Codes are subject to any expiry date or minimum spend stated at the time of issue.
  • We reserve the right to withdraw or modify a promotion at any time without prior notice, provided this does not affect Orders already confirmed.
  • Promotional codes have no cash value and cannot be exchanged for cash.

10. Production & Delivery

Each DreamPop Tales book is made to order using the personalised information you provide. Production begins shortly after your Order has been confirmed.

A. Production Times

Estimated production and dispatch times are displayed on our Website and during checkout. While we always aim to meet these estimates, production and delivery times may occasionally vary due to factors beyond our reasonable control, including peak seasonal demand, supplier delays, courier disruptions or unforeseen circumstances. Estimated delivery dates are provided for guidance only and are not guaranteed.

B. Delivery

Your Order will be delivered to the shipping address provided during checkout. It is your responsibility to ensure that all delivery information is accurate before completing your purchase. If an Order is returned due to an incorrect address, failure to collect or refusal of delivery, we may charge additional shipping costs before re-dispatching.

C. Inspecting your order

Please inspect your Order as soon as reasonably possible after delivery. If your Product arrives damaged, defective or incorrect, please contact us within 14 days of receipt with photographs showing the issue.

D. Risk and ownership

Ownership of your Product passes to you once payment has been received in full. Risk of loss or damage transfers to you once the Product has been delivered to the address provided at checkout.

11. Product Information

We make every reasonable effort to ensure that product descriptions and information on our Website are accurate. However:

  • colours may vary slightly between your screen and the printed Product due to differences in monitors, mobile devices and printing processes;
  • product photographs shown on our Website are intended as examples and may differ slightly from the final printed Product;
  • minor variations in print positioning, trimming or colour are a normal part of the printing process and do not constitute manufacturing defects; and
  • product dimensions and specifications are approximate unless otherwise stated.

12. Liability

We are committed to supplying Products of satisfactory quality that match their description on our Website.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law.

Subject to the above, DreamPop Tales shall not be liable for any indirect, incidental, consequential or special losses arising from your use of our Website or Products, including loss of profits, revenue or data. Our total liability in relation to any Order shall not exceed the amount paid by you for the relevant Product.

Your use of our Website is at your own risk. While we take reasonable steps to ensure our Website is secure and available, we do not guarantee that it will always operate uninterrupted or be free from errors, viruses or other harmful components.

13. Force Majeure

DreamPop Tales shall not be liable for any failure or delay in performing our obligations where this results from circumstances beyond our reasonable control.

These circumstances may include, but are not limited to:

  • natural disasters;
  • severe weather conditions;
  • fire or flood;
  • war, terrorism or civil unrest;
  • pandemics or public health emergencies;
  • government actions or legal restrictions;
  • strikes or industrial disputes;
  • power failures or internet outages;
  • courier or postal service disruptions;
  • supplier failures; or
  • any other event beyond our reasonable control.

Where such circumstances occur, we will make every reasonable effort to minimise delays and fulfil your Order as soon as reasonably practicable.

14. Privacy

We process your personal information in accordance with our Privacy Policy.

By placing an Order or using our Website, you acknowledge that you have read and understood our Privacy Policy.

Our Privacy Policy explains:

  • what information we collect;
  • how we use your information;
  • how we protect your information;
  • your privacy rights; and
  • how to contact us regarding your personal information.

Our Privacy Policy forms part of these Terms & Conditions and should be read together with them.

15. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Romania.

Any dispute arising out of or in connection with these Terms & Conditions or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts of Romania, unless mandatory consumer protection laws in your country of residence provide otherwise.

Nothing in these Terms & Conditions affects any mandatory rights you may have under applicable consumer protection legislation.
